# How the womanizers were punished in the Kazakh steppe in the 700th?

In October, I visited a thematic exhibition on "The judiciary in Kazakhstan: History and Modernity". Former Head of the [EU project](https://www.eucj.kz/en/project) "Enhancing Criminal Justice in Kazakhstan" William Irvine asked me to help with translation into English. He was very impressed with the exhibition, organized by the Supreme Court in the framework of the VII Congress of Judges of Kazakhstan. The European expert was very happy after learning that the exhibition would last long and was open to everyone. You can read his interview in Russian about the great Kazakh heritage here.

The exhibition guide in the dazzling blue color suit told us about the formation and development of the national judicial system from the ancient times to the present day. According to her, 245 exhibits in the form of photos / videos were represented there. I will try to convey the spirit of the event and talk about the rich history of the exhibits from her words.

 

**So the exhibition was organized in three main sections:**

 

1. "Traditional law and the judiciary in Kazakhstan in ancient times, the Middle Ages and the pre-revolutionary period";

 

2. "Justice system in the new historical period of Kazakhstan";

 

3. "Formation and development of the judicial system in the years of Independence of the Republic of Kazakhstan."

**And who is to judge? Kagan!**

 

Interestingly, the first section of the exhibition started from... the Turkic khanate era. The photos of sculpture of outstanding leader and commander **Kultegin** as well as the golden crown of **Bilge Kagan**, dating back to the VI-VIII centuries AD were particularly interesting for us. For me it was a discovery that the judiciary practices stems from the times of Turkic khanate. Several Turkic tribes that roamed the territory of Kazakhstan decided to unite in the middle of the VI century to form the Turkic Khanate. Kultegin became a chief and commander, and his elder brother Bilge became the ruler of the East Turkic Khanate. Golden Crown of Bilge Kagan symbolizes his supreme rule, which provided a twenty-year peace (722-422), to the entire Turkic Khanate.

Bilge Kagan, while dealing with governance issues, at the same time administered justice. The Turkic Khanate was notable for its exceptional system of existing rights based on the traditions and customs of the Turkic of that time. During this period, the death penalty was applied for a crime against Kagan, murder of other rulers and kidnapping horses (since cattle was the main source of wealth to nomads). The “Casanovas” (an Italian adventurer whose name is now synonymous with "womanizer") of the steppe were also death penalized for seducing wives of other men.

Already at that time there was a system of **paying ransom** under the protection of property and personality of the nomad considerations: "That who stole the horse and other belongings has to pay 10 times more of the cost of theft"; "That who had hurt the eyes of others has to give up his daughter, if he had no daughter, he gives the wife's property; That who had injured somebody’s body pays a horse."

 

Even more surprising was that **the elements of the Turkic Khanate rights system is reflected in the current criminal and administrative law.** For example, alternative penalties such as fines for crimes of medium and low severity are used today.
